Welcome to Great West Pay (“we,” “us,” “our”). By using our services—including mobile merchant solutions, retail and ecommerce payment processing, ACH transfers, POS integrations, MOTO (mail-order/telephone-order) transactions, and SMS messaging services—you agree to these Terms & Conditions.

1. Services Overview

We provide a secure, PCI-compliant suite of payment processing tools, along with SMS communication services:

  • Mobile payments for on-the-go businesses
  • Brick-and-mortar merchant accounts with POS integration and loyalty features
  • Ecommerce gateways compatible with major shopping carts and custom platforms
  • ACH processing for recurring billing, payroll, and B2B transfers
  • MOTO transaction support for phone or mail orders
  • SMS messaging services for transaction alerts, account updates, and verification codes

2. Account Setup & Activation

To begin, you’ll go through:

  • A consultation to understand your industry-specific needs
  • A streamlined application process requiring standard documentation
  • Underwriting, supported by our experienced team
  • Activation and onboarding, often within 48 hours

3. Merchant Obligations

As a merchant, you must:

  • Provide accurate business and documentation details
  • Accept responsibility for all charges and fees incurred
  • Comply with relevant laws and credit card network rules
  • Maintain proper security standards for cardholder data
  • Use the services (including SMS) only for lawful and permitted transactions

4. Fees & Payment Terms

You agree to pay applicable fees for:

  • Authorization, processing, and settlement services
  • PCI compliance and gateway fees (if applicable)
  • SMS messaging services, if opted in (charges may vary by carrier or usage volume)
  • Chargebacks or reversals resulting from prohibited or fraudulent activities

5. SMS Messaging Services

  • By using Great West Pay’s SMS services, you consent to receive text messages related to account activity, verification codes, payment alerts, service updates, and promotional content (if opted in).
  • Standard messaging and data rates may apply, depending on your mobile carrier.
  • You may opt out of promotional SMS at any time by replying “STOP.” Transactional or security-related SMS (e.g., fraud alerts, verification codes) may still be sent for account safety.
  • You are responsible for ensuring that the mobile number you provide is accurate and up-to-date.
  • Great West Pay is not responsible for delays or failures in SMS delivery caused by mobile carriers or third-party providers.

6. Chargebacks & Fraud

In the event of a chargeback or fraud alert:

  • You must cooperate fully with any investigation or remediation
  • Great West Pay may mandate additional security or controls
  • Failure to comply may result in suspension or termination of services

7. Liability & Indemnification

  • We process payments and deliver SMS services “as is,” and are not liable for indirect, special, or unauthorized use damages.
  • You agree to indemnify us from claims arising from your misuse of payment or SMS services.

8. Term & Termination

  • These terms remain effective until either party ends the agreement.
  • We may terminate services immediately for legal or compliance violations.
  • You are responsible for covering all outstanding fees up to service termination.

9. Privacy & Data Security

Your data is protected under our Privacy Policy. SMS numbers are collected solely for account-related communication, alerts, and optional marketing (if opted in). We do not sell or share your number with third parties without consent.

10. Compliance & Regulatory Matters

By using our services, you affirm compliance with applicable regulatory standards based on your industry. For SMS, you must comply with applicable TCPA (Telephone Consumer Protection Act) and carrier guidelines for customer communications.

11. Amendments to Terms

We may update these terms from time to time. We’ll notify you of significant changes via email, SMS, or your account dashboard. Continued use of services confirms your acceptance of any updates.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware. Any disputes will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), unless local law directs otherwise.
